Ordinances

Ordinances are local laws enacted by Mayor & Council and generally take the form of an amendment to the Delaware City Code. Rezonings and franchises, such as cable television or garbage collection, are also implemented by ordinance, as are proposed amendments to the City Charter. Charter amendments, however, are only effective upon enactment of legislation by the Delaware General Assembly.

The ordinance process requires two public readings at different meetings and a public hearing before adoption. An affirmative vote by majority of all the members of Council is required to adopt and ordinance. The Mayor has the power to veto ordinances and a 4/5 vote of Council is required to override a veto.

In 2001, Mayor & Council codified all the City’s ordinances creating the Code of the City of Delaware City. Ordinances adopted subsequent to 2001 amend the Code and are incorporated in it.
